270,000 Nigerian children living with HIV – UNICEF | Mr Olumide's Blog

The United Nations Children's Fund ( UNICEF ) has said that at least 270,000 children aged 0 to 14 years were living with the Human Immunodeficiency Virus (HIV) in Nigeria as at 2016.

The figure represented the lion share of half of the 540,000 total infected children in West and Central Africa over the same year.


Nigeria also recorded 37,000 new HIV infections among children out of the total of 60,000 new infections in West and Central Africa over the same period, representing 62 per cent of the new infections.

The UN children's agency warned that the West and Central Africa were lagging too far behind the rest of the world in access to HIV treatment and care.



The UNICEF Director, West and Central Africa, Ms Marie-Pierre Poirier, in a report released on Tuesday, called for improvement of early diagnosis and access to HIV treatment and care for children.

Another 257 Nigerians arrive from Libya | Mr Olumide's Blog

A few hours after 144 Nigerians voluntarily returned from Libya, another aircraft carrying 257 of their compatriots on Wednesday landed at the Murtala Muhammed International Airport, Lagos.

The spokesperson for the Lagos Airport Police Command, Mr Joseph Alabi, confirmed this in an interview in Lagos.



Alabi said the returnees arrived aboard a Libyan Airlines aircraft at the Cargo Wing of the airport at about 1.30 a.m.

He said they were assisted back to Nigeria by the International Organisation for Migration ( IOM ) and the European Union ( EU ) after being stranded in the volatile North African country enroute Europe.

Alabi said
 "We received another batch of Nigerians early this morning from Libya.
"They comprised of 65 adult females, 179 adult males, seven children and six infants."

He also confirmed that four of the returnees had medical cases and were promptly taken away on an ambulance for treatment.

Report says another set of 144 Nigerians had arrived on Tuesday at about 6.45 p.m. aboard a chartered Buraq Airlines aircraft with registration number 5A-DMG.
The Federal Ministry of Foreign Affairs, in a statement signed by the Spokesperson, Mr. Tiwatope Elias-Fatile on Tuesday, said the country's embassy in Libya had been visiting detention camps to identify Nigerians for registration.

The ministry stated that those registered were issued Emergency Travel Certificates.

The ministry also explained that the embassy, in collaboration with the IOM, repatriates 250 migrants weekly and had returned 3,000 of them so far.

"From the 2,778 registered Nigerians who are still in detention camps, another set of 250 Nigerian migrants will be arriving on Tuesday December 5 via the Murtala Mohammed Airport, Lagos, at 7.00pm, to be received by NEMA officials.
"The Embassy, in collaboration with the IOM, repatriates 250 Nigerian migrants by flight to Lagos weekly – each flight can accommodate only 250 passengers.
"The repatriation is a continuous exercise and the Embassy routinely issues the requisite travel documents to the migrants.
"The Embassy will continue to engage the legitimate government in Libya and other stakeholders in addressing the plight of Nigerian migrants in that country."

The ministry further said the Foreign Affairs Minister, Geoffrey Onyeama, had invited the Nigerian Embassy's Head of Mission, Mr. Iliya Fachano, to Abuja for consultations.

"He is in Abuja already and during the period of the consultations, arrangements have been made for him to address press conferences on the issue.

Fire consumes family of 4 in Lagos | Mr Olumide's Blog

An overnight fire has killed a family of four, simply identified as Eze's family, at No. 13, Buraimoh street, Bariga area of Lagos.

The Director of Lagos State Fire Service, Mr Rasak Fadipe, confirmed the incident to the News Agency of Nigeria (NAN) on Wednesday in Lagos.

Fadipe said the incident occurred at about 2.48 a.m.


He said personnel of the service got to the scene of the incident as soon as they got information about the fire, but that due to the double burglary irons on the door and window of the apartment, they were unable to reach the victims in time.


"The apartment is a chemist store. The father, mother, and two children of ages five and eight were found dead inside the store.
" We advise that although one needs security in his or her house or business place, it should not be to the detriment of the people.
"Members of the family should always know the exist of their apartment whenever there is an emergency," the director said.

Some sources told NAN that the deceased woman was pregnant mother of the two children, and that
the fire started after electricity supply was restored to the area.

Others believed that the fire could have been caused by candle light.

Mother of Kidney Failure Patient is Greedy, took away N3.9m, says NGO

The owner of a non-governmental organisation, Dignity for the Helpless Foundation (DHF), Pastor Samuel Brown, has disclosed that the mother of Tochi, a kidney failure patient, Ndidi Mbonu, is using her daughter to make money.

Pastor Brown, in a 12-page document, explained that his organisation had already given the family about N3.9m as against the N1.4m Ndidi said she collected.

He said the NGO later realised that the family, while getting money from the group, was also raising money through some other platforms.

The Punch had reported that Tochi, a graduate of the Benue State University, became deaf in India after being on dialysis for two years in the country.

She was on dialysis in Nigeria for one year before being flown out in 2015.

Her mother, Ndidi, said she was stranded with her daughter in India due to lack of funds for her kidney transplant, adding that she had resorted to selling beans cake (moin-moin) for survival.

She had said her family was introduced to Brown's NGO in 2015 and an agreement was reached to raise N11m for Tochi's operation.

She explained that Brown also agreed to open a joint account with the family to ensure transparency and accountability.

Tochi's mother said she was surprised when the NGO opened an account without involving any member of the family.

Ndidi said Brown had only given them N1.4m, adding that he paid N30,000 every two weeks to reach the sum about a year ago.

Tochi, who chatted with Punch on WhatsApp, had begged for help from Nigerians, saying her condition was becoming critical.

The NGO, however, said Ndidi was blackmailing the organisation after she had threatened to deal with the owner if she didn't get N6m.

Brown said during the first meeting between the NGO and the family in September 2015, the widow said the family needed about N4m for regular dialysis and treatment of her daughter.

Ndidi was alleged to have authorised the organisation to raise funds with the girl's name in October 2015, just as DHF increased the target to N6m to enable the victim to be on dialysis for at least one year.

In October 14, 2015, it was reportedly agreed that Tochi, Brown and the group's manager, Shallom Ufforth, would be co-signatories to the account.

Brown said the group placed adverts and ran stories in media houses to start the campaign.

He said Ndidi later called to inform them that the family had decided to move Tochi to India for a kidney transplant, adding that she demanded that N6m be raised for the operation.

"Right there in the office, we started discussing our experiences concerning the matter. Since she was spending N27,100 per session for dialysis in the hospital, that means if we want to go by doctor's advice, three times a week will be N81,300. That was how we raised the amount to N11.5m. The hospital documents in her hands and our inquiries suggested that some people may go through dialysis for two to three years before the transplant is carried out," Brown added.

He said the group had paid Ndidi about N2m, which were not documented, adding that sometime in January 2016, based on her instruction, the NGO sent N50,000 and N200,000 to the account of one Oluwafemi Bukola.

Brown said sometime in June 2016, Tochi's mother started making unfounded claims about the amount raised by his organisation with a threat to blackmail him if she didn't get N6m.

"I called her on September 11, 2016, and asked her to check her record; that only that year alone, she had collected N1,150,000. She said, 'Are you not making money too?' This was when it dawned on me that this woman was up to something.

"When I asked her if she recalled that she had collected N2m from us before the N1,150,000, she said she thanked God that the money was not paid into her account and that she would deny it.

"At some point, we started begging her that we wanted to use her Indian line to campaign so that when people called, she would give them situation reports. She said she would deny that she was aware of the campaign if anyone should call her. She said she would be happy with us if we give her N6m cash," Brown added.

He noted that the NGO later learnt that Ndidi had earlier raised N10m through two media houses before she approached them, adding that he was disappointed that the family never mentioned that to them.

Brown said while he was planning another round of campaign to raise funds, he saw a publication on Tochi's condition and her mother's allegations against the group.

He said, "This woman has collected money from us to the tune of N2m without record. We told her that she should have told us that she had already gone far with the media (in raising funds); if we knew, we would not have involved ourselves.

"Since then, she had been threatening that if I didn't give her the family's share of the money, she would rubbish me and my foundation. She said I should remember that I am a pastor and she is a widow; that people will believe her more than me."

He said with payment for adverts, the organisation had spent a total of N4,727,611, adding that he had yet to raise up to N5m.

Lagos Lawmakers Honour Disabled Ex-Street Beggar Turned Lawyer, Medical Student Record Breaker

The House of Reps on Tuesday honoured Mr Abdulsalam Kamaldeen Idowu, a disabled and former homeless street beggar for sponsoring himself through school to become a lawyer and political science graduate and Miss Aarinola Olaiya of Obafemi Awolowo University, Ile-Ife for attaining exceptional record in her academic pursuit.

The decision followed the adoption of a motion sponsored by House Leader, Femi Gbajabiamila.

The House resolved to establish, by law, a Parliamentary Honours/Award System for recognition of extraordinary achievements by Nigerians.

Gbajabiamila while introducing the Honourees said that the motion was intended to reward excellence and encourage citizens who had elevated the ideals of the Nigerian society.

"When ordinary Nigerians do Extra ordinary things then they must be celebrated and all men and women of power and influence must rise and bow to them", he said . "Nigerians and the world celebrate Messi and Ronaldo everyday for the amazing things they are able to do with their legs and today we must celebrate Abdulsalam for the amazing things he has been able to do without his legs", the House Leader added.

According to him, Abdulsalam Idowu displayed resilience and hard work by studying political science and law from street begging and despite being homeless for years sleeping at Idumota Motor Park in Lagos.

"Idowu lost his two legs to polio at the age of three, lost his mother at the age of four, started primary school at eight and resorted to street begging to raise money to buy uniforms, books and to feed. "He begged for arms from primary through secondary school and was known on the streets of Lagos as a beggar.

"From street begging he bought GCE form in 2002, sat and passed the GCE and Joint Admission and Matriculation Board (JAMB) exam and was subsequently admitted to study political science at the University of Lagos. "As he was preparing to complete his first degree, he sat for the West African School Certificate Examination and JAMB.

"In his determination to become a lawyer, passed the exams studied law and was later admitted to Nigerian Law School in 2015 and was called to the Nigerian Bar on Nov. 30 2016," he said.



Gbajabiamila informed his colleagues that Ayodele Dada of Adisa Bashua Street, Surulere 1, federal constituency, Lagos who was similarly introduced to the House and the world in same manner on the 26th of March, 2016, for breaking the 5.0 Cumulative Grade Point at graduation in the University of Lagos just concluded his service at the Central Bank of Nigeria and preparing to further his studies abroad after receiving several job offers and do believe that Aarinola and Abdulsalam will soar higher as well.

Fake SARS Officers Arrested In Rivers State

Two persons parading themselves as officers of Federal Special Anti-Robbery Squad (F-SARS), have been arrested by Rivers State police command.

The suspects; Kenneth Obunwa, and Oluwagbenga Abe, were apprehended on Tuesday morning at the Igwuruta area, near Port Harcourt, in Ikwerre LGA of Rivers state.

The state Commander of SARS, Akin Fakorode while parading the suspects, said they were arrested after the command received a distress call around 7am on Tuesday. He said:

"F-SARS received a distress call that Obunwa and Abe, who claimed to be operatives of F-SARS, accosted Pastor Finan and his younger brother and subjected them to thorough search in their compound at Igwuruta, with undisclosed sum of money extorted from them.

"The suspects impersonated as operatives of F-SARS and they have been doing it for a while.

"We quickly responded to the distress call, because the members of the public adequately utilised the distress lines that we gave. We traced the impersonators and we arrested them.

"We have a lot of miscreants who are impersonating security agents, especially F-SARS, thereby harassing, intimidating and extorting money from innocent members of the public, who ought to be very vigilant.

"I wish to admonish members of the public that whenever they find operatives of F-SARS extorting money or persons claiming to be from F-SARS, but involved in impersonation, they should please notify F-SARS through these numbers: 08054000001, 08057000002 and 08057000003, as well as Rivers State Police Command's Control Room numbers: 08098880134 and 08032003514."

Fakorode added that the  suspects would be thoroughly investigated and would appear in court soon to serve as a deterrent to other criminal-minded persons.

2 Babies Dumped By Their Mothers; 1 dead, 1 rescued alive

According to reports, two babies were found after being dumped by their mothers in parts of Kebbi state. One of the babies was found after the JNI Office in Birnin Kebbi and the other was picked up in Bawada area of Gulumbe district in the state.

One of the babies was rescued alive, sadly the other was found dead in a polythene bag.

Alleged Kidnapper of CBN Governor’s Wife Dies in Custody

A suspect, Umar Abubakar, who, in September 2016, allegedly led others to kidnap Margaret, wife of the Governor, Central Bank of Nigeria, Mr. Godwin Emefiele, has died in police custody.

Abubakar, also known as Kerewa, was said to have died due to the injuries he sustained during a gun duel with policemen in his bid to evade arrest.

The deceased as well as Mohammed Yusuf, Edwin George, Musa Maidabara, and Ernest Uduefe, was to be arraigned before Justice Babatunde Quadri of the Federal High Court in Abuja on Tuesday.

But the arraignment could not proceed due to Abubakar's death, which the lead prosecuting counsel, Mr. Aminu Alilu, announced to the judge during the proceedings.

Alilu of the Office of the Attorney General of the Federation, said, "This charge was filed on October 7, 2017, but on October 24, we were informed of the demise of the first accused who died as a result of injuries he sustained while in the course of exchanging gunfire with the police."

Justice Quadri directed Alilu, an Assistant Chief State Counsel in the Office of the Attorney General of the Federation, to amend the charges to reflect the new set of defendants.

He then adjourned until December 14 for the arraignment of the surviving defendants.

In the five counts filed against the defendants, the prosecution alleged that the late Abubakar and the four other defendants took hostage of Margaret along with others in her entourage – Odion Anthony, Ngozi Omoile, Uju Anthony and Gladys Omoile – at Ugoneki village, along the Benin/Asaba Expressway on September 28, 2016.

The AGF filed five counts under the Terrorism (Prevention) (Amendment) Act 2013 against the alleged kidnappers.

The defendants demanded N100m from the victims' family members, but upon negotiation, reduced the ransom to N80m, which they allegedly took before releasing the victims.

All the five defendants were named in counts one to three which have to do with conspiracy and hostage taking.

But the trio of George, Maidabara, and Uduefe, were accused in count four of aiding and abetting the act of hostage taking.

Female student drugged, r*ped by man she met on Instagram

A man identified by the Nigerian police as Asiwaju Micheal has allegedly drugged and r*ped a female undergraduate of the University of Ilorin.

The Command's Public Relations Officer, Akayi Okasanmi, in an interview with Punch in Ilorin, the state capital on Monday, said the victim, whose name was withheld and Michael had met on the social media platform - Instagram - and started a relationship.

He said the victim had, in her statement, claimed their relationship was not amorous until Michael invited her to a hotel.

Okasanmi said, "He later drugged the girl and slept with her. While she was unconscious, he took photographs of her n*de body. When the girl woke up, she found out that the guy had r*ped her. She left in annoyance and vowed not to come back to him.

"When the girl left, the guy called her for s*x. When the girl refused, he threatened to expose her n*de pictures to the public. The girl went to him and pleaded with him to delete the pictures. He made love to her and went on to forward one of the pictures to the girl's father. But the picture was intercepted by the lady's older brother who was in possession of the father's phone at that time."

The PPRO said that after the student returned to school, Michael continued to threaten her.

He said the victim spoke to her pastor about what she was going through and the latter advised her to play along so that the suspect could be arrested. Michael was eventually tricked to come to Ilorin and later, arrested in a hotel.

Okasanmi said, "We laid a trap for him. He called the lady at about 12.30pm and told her to meet him somewhere. Maybe he sensed that something was amiss. But eventually we arrested him in a hotel and took him to my office. By that time it was late.

"I asked an officer from the State Criminal Investigation and Intelligence Department to take his statement and he confessed. I collected one of his cell phones, searched and found some of the lady's nude pictures in it. We made him to write a statement confirming what he did.

"Later, I left the SCIID officer to watch the suspect, while I went home to dress because we were expecting one of our principal officers from Abuja and we were to receive him at the airport at about 8am. By the time I returned to the office, the suspect had disappeared. The CID officer told me that he left him in the care of other people. For that reason, the boy defaulted and he is going to face trial."

When contacted, the Deputy Director, Corporate Services, Unilorin, Mr. Kunle Akogun, declined to comment on the matter. He said, "I have no comment. It is a police matter."

A Bronx man who strangled his ex-girlfriend and their 4-year-old son pleaded guilty in the killings Tuesday.

Isaac Duran Infante, 24, admitted murdering Felicia Barahona, 36, who was his science teacher at DeWitt Clinton High School, and little Miguel inside their W. 153rd St. apartment on Dec. 22, 2016.


Infante confessed to investigators that Barahona was "still gasping for air and fighting for life," when she screamed for their son to call 911, according to a statement read by prosecutor Nicole Blumberg in Manhattan Supreme court..
Barahona started a sexual relationship with the student in 2011, when Infante was 18 years old.

Five years later, her former student used an electrical cord to end her life.Five years later, her former student used an electrical cord to end her life."The defendant wrapped the cord even tighter around her neck until he was sure that she was dead," the prosecutor detailed..

Once Barahona was dead, Infante turned his sights on his own child, who he strangled and left "lying face-down in a bathtub filled with water," Blumberg added.

In a deranged attempt to cover up the crime, Infante tried to convince police the killings were a murder-suicide.

Court Orders Forfeiture of Diezani’s Two Additional Houses

The Federal High Court in Lagos has ordered the temporary forfeiture of two additional properties in Lagos linked to a former Minister of Petroleum Resources, Mrs. Diezani Alison-Madueke.

The said properties, according to the EFCC, are valued at $4.76m.

The anti-graft agency listed them as Penthouse 21 building 5, Block C, 11th floor, Bella Vista Estate, Banana Island, Ikoyi and Penthouse 22, Block B, Admiralty Estate, Ikoyi, Lagos.

Counsel for the EFCC, Mr. Anselem Ozioko, said the anti-graft agency reasonably suspected that the properties were procured with proceeds of alleged unlawful activities of Diezani.

Justice Mojisola Olatoregun ordered the temporary forfeiture of the properties after entertaining an ex parte application by the EFCC counsel.

Those listed as defendants on the face of the court papers are Diezani, Donald Amagbo, Schillenburg LLC, and Sequoyah Property Limited, as respondents.

The Tuesday's temporary forfeiture came barely two months after the same Federal High Court ordered the permanent forfeiture of 58 houses linked to the ex-minister, who is currently in the United Kingdom, where is equally being probed for alleged corruption.

The 58 houses which were ordered by Justice Abdulaziz Anka on October 11, 2017 to be permanently forfeited to the Federal Government are scattered across Lagos and Port Harcourt.

The EFCC claimed that the ex-minister acquired them between 2011 and 2013 using front companies.

The value of the properties was put at $21,982,224.

Earlier in February, last year, Justice Muslim Hassan of the same court had ordered the forfeiture of a sum of $153,310,000 stashed away by the ex-minister in three commercial banks in the country.

Young Girl Gets Back Her 4-day-old Baby Stolen By Her Benefactor In Calabar

The Cross River State Command of the Nigeria Immigration Service (NIS) has arrested a 62-year old woman who allegedly tricked a 16-year old girl, Oma Samuel, of her four-day-old baby girl for trafficking purposes.

The suspected trafficker, identified as Angela Nwaelechi, was caught at the Margaret Ekpo Airport in Calabar, on her way to Lagos with the baby. Also arrested was one Ifeanyi, a suspected accomplice.

Controller of Immigration in the State, Adeuyi Funke Cecelia, while handing over the matter to National Agency for the Prohibition of Trafficking in Persons (NAPTIP) yesterday in Calabar, said they were arrested on December 1, when the baby was still four days old.

"My officers on duty got alert when an elderly woman was in possession of an infant under the age of one week, asked to be allowed to get baby food from luggage she had already checked in. It became suspicious when they saw and elderly woman without the mother carrying the baby. She was invited to the immigration office in the airport, where it was realized she was trafficking the baby.

"I want to appeal to parents to be on the watch out for their children so they don't fall in to the hands of conmen and women who may want to lure them. What has happened shows that the NIS and its personnel are really positioned to ensure that we crush human trafficking in all the different places we work. This shows diligence on the part of our personnel. They were vigilant and committed and were able to identify that they crime was being perpetrated. We would ensure that people who commit such crime are brought to book," she said.

The Nation reports that Nwaelechi, who said she lives in Lagos, denied she was trafficking the baby.

According to her, she had a younger male relative who had been sick and wanted to help him get healed by bringing him to a church in Calabar and then getting a wife for him.

She said Ifeanyi brought the pregnant Oma who agreed to marry her relative. The elderly woman said when the baby was born the mother agreed that she could go ahead with the baby to Lagos, where she should would join them after.

"She delivered on the 27th of November. And I took care of the expenses. On the said day we boarded a cab to the airport and had to leave the mother in a restaurant to eat. We were leaving her behind as she said she did not want to come to Lagos immediately. It was at the airport that we got arrested when I tried to get food from luggage I already checked in. There was a one-hour delay for the flight so the food made for the baby finished and she needed food. So I went to the officer and told him the baby is hungry and her food already checked in, and he asked me whose baby it was, and he led me and fortunately the luggage was not in and they let me have the luggage and as I was trying to get the food, he went ahead to call the officers and started questioning me. They asked me to call the mother. So I called Ifeanyi and he brought the mother."

Ifeanyi said he found the girl when she was six months pregnant and homeless, sleeping outside a church at Ambo Street. He said he decided to accommodate her even though he was living with his wife and children, until she gave birth.

"The girl stayed with me for over three months before she gave birth. That was before I met this woman who said she needed a wife for her relative and I suggested the girl. The girl said she would not go to Lagos. She gave birth in a church and I called the woman and when she arrived she did all the necessary things. I bought the girl and phone and gave her some money and them Mummy (Nwaelechi), who was on her way to Lagos with the baby, called me and said they were interrogating her at the airport. And I went there with the mother and they arrested us," Ifeanyi said.

Although Oma Samuel admitted that Ifeanyi took her in when she was pregnant and had nowhere to stay, the teenage mother said she never agreed that her baby be taken from her.

She said she had no idea what was going on and was tricked out of her baby by the duo.

"What the woman and Ifeanyi said is false. I did not agree to give my baby to anyone to take to Lagos, where I would join them later. I was tricked. When I had this pregnancy I did not have a place to stay and I was sleeping outside the church. So one morning I saw this man, Ifeanyi, and he asked me what happened and I explained what happened and he told me to come and stay with him until I put to bed and after that I would take my baby home. I accepted and stayed with him. And he told me that a woman is looking for a wife to her and I said but I am pregnant already and he said no problem. Later on when I saw the man, who was an imbecile, I declined the offer. They told me the woman has another son that would marry me. But when I thought about it, I said no, that I don't want to marry anybody again.

"I stayed with him until the day I gave birth and the woman came and I asked who she was and he said she was my mother in law. That same day she wanted to take my baby but I did not accept. Even the women where I gave birth did not accept. So after we stayed until Friday, we blessed the child and I told them I wanted to go back to my place and I packed my things and this woman collected the baby from and we got into a cab. I sat in front and two of them were behind. I noticed through the side mirror that he gave some money to Ifeanyi. I was watching them trying to understand what was happening. They started using their dialect, Igbo, to speak and I was wondering what was going on. When we got to where I was to stop and go down with my baby, they did not stop there. They drove me somewhere stopped and asked me to go down. I asked of my baby and they said I should wait for them that they want to buy something somewhere and come back with the baby. I went down and they left. They did not come back.

"I started crying. The next thing this man rushed and came back and I asked him where my baby was. He took to the market and bought me a phone and bag. He took me and dropped me off in one healing home and gave me N2000 to eat. I just dropped the money and was waiting for the sun to go down so I will go and report to the police with the money. I was still there when Ifeanyi rushed again to me, with his wife this time, and told me that my baby was going to Lagos with that woman who would take good care of her and when the baby grew to two years, I would go and visit her. This was not what we agreed. The man then told me that we should go to the airport and if they ask me anything I should say she is my mother in law. Initially I agreed but later on I said no, that she was not my mother in law. That is how we got here."

Principal Officer of NAPTIP, Odudukudu Victor, said they were taking over the matter.

"We would do our investigation and then send the file to legal and prosecution and the law will take its course,"Victor said.

DSS Embarrassing Your Government With Unlawful Arrests – Falana writes Buhari

Human rights lawyer, Mr. Femi Falana (SAN), has warned President Muhammadu Buhari to end the illegal arrest of innocent law-abiding Nigerians and foreigners by security agencies, especially the Department of State Security (DSS).

He delivered the warning in a letter addressed to the President, saying the DSS has become an embarrassment to President Buhari's government. Mr. Falana reminded the President of his promise to abide by the constitution and ensure that government at all levels is responsible and accountable. He quoted President Buhari as having said: "For I will not have kept my own trust with the Nigerian people if I allow others abuse theirs under my watch."

Contrary to the pledge, said Mr. Falana, the DSS has continued to indiscriminately arrest and detain many citizens and foreigners living in Nigeria. He blamed the development of the failure of the Federal Government to call the DSS to order, a situation that has bred the belief that the President has no respect for fundamental rights.

The lawyer also observed that the repeated disobedience of court orders by the DSS has put a huge question mark on the Buhari administration's claim that it is committed to the rule of law.

"At the recently concluded annual conference of Nigerian Judges, which held in Abuja, the Chief Justice of Nigeria, Justice Walter Onnoghen, was compelled to condemn official disregard for court rulings and orders," Mr. Falana stated. He recalled that during President Buhari's brief spell as a military head of state in the 80s, there were decrees conceived to detain people.

"One of such legislation was the State Security (Detention of Persons) Decree No 2 of 1984 signed by Your Excellency as a military Head of State. Despite the ouster of the jurisdiction of the courts in the decree, the detention of any person, which could not be justified by the detaining authorities, was declared illegal by the courts.

"It is on record that political detainees whose detention orders were quashed by the courts were released from illegal custody. At the end of military rule, the preventive detention decree and other obnoxious decrees were repealed to pave way for the restoration of democratic rule in the country," stated Mr. Falana.

He contended that under the current democratic dispensation, the right of every person to personal liberty is guaranteed by Section 35 of the Constitution and Article 6 of the African Charter on Human and Peoples' Rights.

He equally argued that under the extant human rights law regime, if anyone will be detained beyond 24 or 48 hours, the detaining authority is required to obtain a remand order from a Magistrate Court in line with Section 293 of the Administration of Criminal Justice Act, 2015.

However, he stated that the DSS has continued to violate the constitution, the African Charter on Human and Peoples Rights Act and the Administration of Criminal Justice Act by repeatedly arresting and detaining innocent people without legal justification.

"From the information at our disposal, the DSS has detained several Nigerians and foreigners to settle personal scores. Others have been arrested and detained by the DSS on the suspicion that they have committed criminal offenses, a matter that is within the purview of the Police and the anti-graft agencies.

"To compound the illegality of such arrest and detention, the orders made by competent courts of law directing the DSS to either release or produce detainees in court have been treated with contempt," said Mr. Falana.

Among those affected by this, he disclosed, are; 
Colonel Sambo Dasuki, former National Security Adviser; Mr. Ibraheem Elzakzaky, leader of the Islamic Movement in Nigeria, and wife, Zeinab Elzakzaky; as well as Messrs Nitin Verma and Umesh Asudani, both Indian nationals.

Mr. Falana noted that following the former National Security Adviser's indictment by the Presidential Panel on Procurement of Arms and Ammunition, he arrested and charged with money laundering at the Federal High Court by the Economic and Financial Crimes Commission (EFCC) in 2015.

He was also charged with illegal possession of firearms at the Federal Capital Territory High Court by the DSS. He added that both courts admitted the defendant to bail pending trial. "Even though he met the bail conditions, the DSS has contemptuously refused to release the defendant from custody. The order of the Court of Justice of the Economic Community of West African States directing the Federal Government to release the defendant from further custody has been ignored by the DSS," noted Mr. Falana.

On Mr. Elzakyzaky and wife, he stated that they were arrested after the military invasion and destruction of their home in Zaria, Kaduna State on December 14, 2015. During the invasion, he added, armed troops killed 347 people, including three of the couple.

But on 2 December 2016, the Abuja judicial division of the Federal High Court presided over by Justice G. O. Kolawole declared their arrest and detention illegal and ordered their release from custody.

"The court proceeded to award N50million damages to both detainees and directed the Federal Government to provide them with a temporary accommodation since their residence was burnt down by the rampaging troops with the connivance of the Kaduna State government. The Federal Government has ignored the orders of the court, while the DSS has continued to hold the couple in illegal custody," Mr. Falana stated.

In the case of the Indians, both Kano-based businessmen arrested by the DSS on 5 October 2017 for alleged money laundering, Falana said the order made by Justice Usman Mallam Na'abba of the Kano State High Court for the production of both detainees in court has been ignored by the DSS.

"We have highlighted the aforementioned cases to let Your Excellency appreciate the extent to which the DSS leadership has embarrassed your administration by using the security agency to settle personal scores with political opponents. The DSS may claim that some of the political detainees mentioned in this letter are our clients.

"While that is correct, we have always kicked against the illegal arrest and detention of law-abiding citizens even during the military era. Hence, we did not hesitate to condemn Your Excellency's detention by the Ibrahim Babangida junta even though your military regime had detained some of us," he told the President.

In the light of the foregoing, we urge your Excellency to use your good offices to direct the DSS to either release all the citizens and foreigners being held in illegal custody or arraign them in the appropriate courts in line with the avowed commitment of your administration to respect the fundamental rights of the Nigerian people under the Rule of Law.

Furthermore, the DSS should be directed to desist from further arresting and detaining innocent people and criminal suspects without court orders contrary to the provisions of section 293 of the Administration of Criminal Justice Act, 2015.

Court Unfreezes Patience Jonathan's 16 Bank Accounts

The Federal High Court in Abuja on Tuesday vacated an order it made on May 30, 2017, freezing 16 separate bank accounts linked to wife of former President Goodluck Jonathan, Patience. 

Justice Binta Nyako lifted the order that barred Mrs. Jonathan and 10 organizations connected to her, from having access to the bank accounts containing aggregate sums of $5.8million and N3.5billion.

The court took the decision after it heard an application that Mrs. Jonathan and the companies filed to challenge an ex-parte order that granted the Economic and Financial Crimes Commission, EFCC, interim ownership of funds in the accounts.

The companies that were cited as co-applicants in the motion that the ex-first lady filed through her team of lawyers led by Chief Mike Ozekhome, SAN, were the Incorporated Trustees of Ariwabai Aruera Reachout Foundation, Pagmat Oil and Gas Nigeria Limited, Flinchley Top Homes Limited, Incorporated Trustees of Women for Change and Development Initiative Nigeria, Transocean Property and Investment Ltd, Seagate Property Development Investment Company, Globus Integrated Services and Pluto Property and Investment Company Limited.

Justice Nyako upheld Ozekhome's argument that the interim forfeiture order had elapsed and could not be renewed by the EFCC.

According to Vanguard, the former first lady had insisted before the court that the EFCC obtained the forfeiture order by an improper use of the judicial process.

Mrs. Jonathan and the 10 firms told the court that the said interim forfeiture order, including a subsequent one that was issued on October 18, had since expired, with the EFCC, failing to establish a nexus between the applicants and any act of illegality.

In a six –paragraph affidavit deposed to by one Chinedu Maduba, Mrs. Jonathan and the firms admitted their ownership of the 16 bank accounts.

The applicants told the court that EFCC had before May 30 when it secured the forfeiture order, also filed a similar application that affected most of the parties, before Justice C.M.A. Olatoregun of the Federal High Court sitting in Lagos in suit number FHC/L/CS/1342/2016 with same granted on October 10.

They alleged that EFCC suppressed the fact that it had earlier approached the Lagos Division of court for the same relief it applied for and secured from the court in Abuja.

Mrs Jonathan said, though she was not served a copy of the order that froze her accounts, she said she only became aware of the existence of the forfeiture order from the court in Abuja few days ago during the hearing of a petition she sent to the National Assembly and after some of her co-applicants tried to operate their accounts to no avail.

She argued that the interim forfeiture order had a life span of 90 days commencing from May 30, insisting that the order had long elapsed without any renewal or extension of its lifespan.

"That by reason of these orders, the Applicants have been unable to operate their accounts as the banks who are in custody of their accounts have refused to honour any of the applicants' instructions ostensibly because of the order of this honourable court", the affidavit added.

While five of the frozen accounts are domiciled in Skye Bank Plc with seven of them in Diamond Bank Plc, the remaining accounts are with Union Bank Plc, First Bank Plc, Ecobank and Zenith Bank Plc.

EFCC had in reaction to the application, prayed the court for an extension of the forfeiture order against funds in the 16 bank accounts.

EFCC lawyer, Mr. Richard Dauda also applied for the extension application to be heard first before the application by Mrs. Jonathan and the firms.

However, Justice Nyako, after hearing both motions, said there was nothing before the court to warrant an extension of the interim forfeiture order.

It will be recalled that Mrs. Jonathan had on October 19, also blocked moves by the EFCC to take over assets belonging to her organisation, Ariwabai Aruera Reachout Foundation.

EFCC had in an ex-parte motion it filed before another Judge of the same high court, applied for an order of interim attachment/forfeiture of assets and properties of the foundation at Plot No. 1960, Cadastral Zone A05 Maitama District and Plot No. 1350, Cadastral Zone A00, in Abuja.

The anti-graft agency equally sought for "An order stopping any disposal, conveyance, mortgage, lease, sale or alienation or otherwise of the property/asset described in the schedule attached herein.

As well as, "An order authorizing the EFCC to appoint a competent person(s)/ firm to manage the asset/property listed in the schedule herein, temporarily forfeited to the federal government pending the conclusion of investigation".

The motion ex-parte marked FHC/Abj/CS/872/2017, was predicated on section 6(d), 7(2), 24(a), 26(1), 28 and 29 of the EFCC (Establishment) Act, 2004, section 330(a) of the Administration of Criminal Justice Act, 2015, section 15 of the Money Laundering (Prohibition) Act, 2011, as amended, and section 44(2) (K) of the 1999 constitution, as amended.

The Commission told the court that the assets/properties of Mrs. Jonathan's foundation "are subject matter of investigation, enquiry and examination by the EFCC".

It said there was need to preserve the assets/properties "pending the conclusion of investigation and possibly determination of criminal charges that may be instituted against the suspects.

"If there is any transaction on the property by the suspects by way of disposal, conveyance, mortgage, lease, sale and alienation or otherwise of the asset or property described in the schedule herein, it will render nugatory any consequential order(s) which the court may make if the suspect(s) is convicted of the offences alleged against her/them after possible due trial", the agency added.

Besides, in a 12-paragraphed supporting affidavit that was deposed to by one of its investigators, Mr. Kolawole Mukaila, EFCC said it has a Special Task Force investigating "alleged amounts of money laundered by the former First Lady, Dame Patience Jonathan into various account and properties were purchased with nothing to show for".

Mukaila who identified himself as a member of the special investigating team, averred: "That sometimes in 2016, an alleged case of conspiracy and money laundering was received via intelligence report to the office of the Executive Chairman and referred to my team for investigation.

"That my team swung into action to conduct a discreet investigation by writing letters to Ecobank, Diamond bank, Corporate Affairs Commission and AGIS.


"That in the course of investigation, it was revealed from the responses from the C.A.C and Abuja Geographical Information Systems that the plots of land were allocated to Ariwabai Aruera Reach out Foundation belonging to the former first lady, Patience Jonathan and her allies.


"That investigation further reveals the accounts held by Ariwabai Aruera Reachout Foundation had the former first lady, Patience Jonathan as one of the trustees and signatories of the account. Copies of the response from Diamond bank and Ecobank are hereby attached and marked as Exhibit EFCC 2A- 2B respectively.


"That investigation also revealed that the plots of land were allocated in 2010 and the Certificate of Occupancy was issued in 2011.


"That all the above stated payment/transfers/purchases had no contract award backing it up whatsoever and as such was reasonably suspected to be fraudulent payments and an illegal dissipation of the nation's resources", he added.

However, the former first lady persuaded the court presided by Justice Nnamdi Dimgba to suspend hearing on the ex-parte motion to enable her to respond to the application.

Mr. Jonathan said she got wind of EFCC's plans and decided to file a counter-motion in opposition to the interim forfeiture order request.

She prayed the court to strike out EFCC's ex-parte Originating Motion dated September 20 on the ground that the court lacks the jurisdiction to entertain the application.

Mrs. Jonathan insisted that the motion was legally defective, insisting that 'Ex-parte Originating Summons' "is not one of the modes of commencement of action under Order 3 Rule 1 of the Federal High Court (Civil Procedure Rules) 2009, and it is not known or provided for by any law or rules of court".

She argued that the motion was an abuse of court process as it was filed "to overreach the Fundamental Human Rights suit pending before this court in suit no. FHC/CS/586/2017, filed by one of the trustees of Ariwabai Aruera Reachout Foundation, against the said EFCC, with respect to the assets/properties of the said Ariwabai Aruera Reachout Foundation, sought to be forfeited by the EFCC through the instant 'Exparte Originating Summons".

Mrs. Jonathan, through an affidavit also deposed to by Mr Maduba, told the court that the NGO was founded in 2006 when she was the first lady of Bayelsa state, in conjunction with other trustees.

"That the said NGO was registered as a charitable organization and in the last 10 years, it has carried out several charitable programmes, in line with its objectives. Some of the programmes include vocational training for women, treatment of people with heart and kidney problems within the country and abroad, as well as assisting less privileged generally.


"That recently, the Respondent herein began to harass Mrs. Patience Jonathan, her relatives and the NGO, by indiscriminately freezing their accounts, even without court order, breaking into their properties, sealing off the NGO's properties without an order of court. That the actions of the Respondent led to the filing of a Fundamental Human Right suit against the Respondent by Mrs. Patience Jonathan".

Justice Dimgba has fixed January 22, 2018, to hear the matter.

..."Timetable Must be Followed" Says Senate President The 8th Senate has passed the Second Reading of the 2018 Appropriation Bill. The Bill has been forwarded to the Committee on Appropriations and its various sub-committees for further consideration and budget defence by the various ministries, departments and agencies of the Federal Government.

Speaking on the passage of the Second Reading of the Budget, the President of the Senate, Dr. Abubakar Bukola Saraki said: "We know that the timetable is very tight. We will be suspending plenary for us to be able to start the defense of this budget. Committee Chairmen and Members should please ensure that we keep to this timetable.

"Let me respond with a general note of warning to all Heads of MDAs to ensure that they strictly respect the letters of invitation and the timetable. This is not time for excuses for Ministers or Heads of parastatals to be traveling and not be able to attend their budget defense.

"We do not have the time. This is a very short timeframe, therefore, I expect all MDAs to be able to respect our invitation and be there on time so that the Committees can wrap up and be able to present their reports by the time we come back on Tuesday, the 19th of December," he said.

The President of the Senate also announced that the Senate will be having a public hearing on the budget.

"Distinguished Colleagues, let me also thank you for what you have contributed to this process. I know that we have a lot of work ahead of us.

"There will be a Public hearing on the Budget. We are looking at Monday, the 11th of December, however, in the next few days, an announcement will be made – we expect attendance by all Senators."
